On 24 September, the Paris Court of Appeal ruled in favour of Orange in the case of its dispute with SFR over fixed telephony offers to second homes, dismissing SFR's case in its entirety and requiring it to pay back more than €50 million to Orange.
SFR had accused Orange of abusing its dominant position and had brought the case before the Paris Commercial Court in 2012. After numerous twists and turns, the case was referred for the third time to the Paris Court of Appeal. The Court of Appeal followed the Court of Cassation's referral ruling and judged that Orange had not committed any fault or abuse of a dominant position.
Latham & Watkins represented Orange in this case with partner Adrien Giraud and associate Laure Maes.
